Right to Information Act, 2005A Historic Legislation Ensuring Transparency and Accountability in the Administrative System

The Right to Information Act, 2005 (RTI) is an Act passed by the Indian Parliament to ensure transparency and accountability in the governance system. This law grants full authority to every Indian citizen to access information held by government institutions.

Main Objectives

  • Ensuring Transparency: Making the functioning of government systems transparent to the general public.
  • Eradicating Corruption: Preventing corruption by keeping citizens informed of administrative matters.
  • Public Participation: Empowering citizens to participate more actively in the democratic process.
  • Accountability: Making government officials more accountable to the public.

Application and Time Limit

  • To whom should it be submitted?: Applications can be submitted to the Public Information Officer (PIO) of the respective office.
  • Fee Structure: The standard fee is ₹10. Individuals living Below the Poverty Line (BPL) are completely exempted from paying this fee.
  • Timeframe to receive a response:
    • General cases: Within 30 days
    • Through Assistant PIO: Within 35 days
    • Matters affecting life and liberty: Within 48 hours

Appeals System

An appeal can be filed if information is not received or if the received information is incorrect:

  • First Appeal: Must be submitted to the higher official in the same office within 30 days from the expiry of the response period or from the date the response was received.
  • Second Appeal: If the issue is not resolved in the First Appeal, a second appeal can be filed with the State/Central Information Commission within 90 days.

Exempted Information (Section 8)

In the interest of national security, there is no obligation to provide the following information:

  • Matters affecting the security, sovereignty, and strategic interests of the nation.
  • Information expressly forbidden to be published by any court of law.
  • Information received in confidence from foreign governments.
  • Matters that would endanger the life or physical safety of any person.

Penalties

The law provides that if an official fails to provide information without reasonable cause or rejects an application, the Commission can impose a fine of ₹250 per day, up to a maximum of ₹25,000.
